UKBA ... Incompetence or Lying?

UKBA (Border Force) definitely don't like you recording the interviews. ln fact they are getting quite upset about it. So much so, that some officers are now trying to force people not to record them. They are doing this by stating that you are not allowed to do it! This is FALSE ... they CANNOT stop you. UKBA Officers that tell people this are either incompetent (don't know their own regs) or are intentionally lying.

They want to keep their illegal harassment and intimidation of cross-border shoppers a secret so they can continue to rob legitimate shoppers.

Our advice is to tell them you are recording them on your phone but have a recording device covertly recording them too. This is not illegal. Then, if they make you switch your phone off because you don't feel you want to argue the point ... you still record the interview. You will then have a factual recording of the interview plus evidence of harassment,

We suggest recording devices like this or this  Personally we like the Sony because of it's quality and build. Shop around, we got ours for £25. Whichever you go for GET a recorder! ... and USE IT!

Oh and remember .... DON'T sign their notebook ... EVER!

  2. One of the things that I noticed when they asked me to turn off the camera was that they 'asked'. As Zaphod has pointed out before, all they can do is 'ask' ie get you to compile by saying things like ' I require you to turn off the recording' ,' I need you to stop recording'. They aren't allowed to order you to stop...they can only 'suggest' it and hope you'll hear the request as an order.

  4. I want to add something to SH's advice: Don't use a spy cam for your covert recording if you can avoid it. The problem is that most of the inexpensive spy cams that can be bought on ebay et al are made in China by a child who works for a bowl of rice a day and they, the cameras, are really dodgy quality and prone to fail right when you need them! That's what happened to me despite my testing it again before hitting the Sked Shed. So for your back up use a decent audio recorder as SH suggests- i will be next time (although i'll still have at least one spy cam running for the puUUUrdy pictures :) ).

  6. ASSISTANT officer Miss Nicola Burnside 47 now Brown declared under oath on 27 th Feb 2012 at AYR SHERIFF COURT "No passenger will ever record my voice during an interview" That sounds a bit definate.
    SHE ALSO DECLARED LIKE HER FRIEND Kevin Lazzerini, no one would read the notebook back to a victim only them.

  8. My mobile will record for 6 hours. How would they know that I was recording if I had the mobile switched on and in my shirt pocket?

    Does it defeat the objective if they do not know? I don't think so. I want the recording for MY puposes, and not for theirs.

    A similar situation arose a couple of months ago. I took pictures of a certain person to show that that person was unharmed. It said that it was illegal to take pictures of a person without that person's permission. I just laughed - I was IN MY OWN HOME!

    1. Junican ... we've found so far that telling them they are being recorded makes them behave although you have to stand your ground if they try and make you stop recording and then delete it.

      Covert recording will get the interview recorded but they won't be behaving themselves. This could quite easily lead to your goods being seized and going through the appeals/condemnation proceedings process. You may be getting your goods back but it will take time and cause you inconvenience.

      Depends what ones objectives are ... to keep your goods or to expose them for what they are.

    Even if one does what I did and does graciously acquiesce to their request to desist recording (at least the non covert one) they, the BF Officers, have had their cards marked and know that you are not going to be an easy victim -especially if you've produced the FOI and an SOT-and they will probably still behave (No doubt because they suspect you have a secondary recording going).

    1. l agree with you 100%. One should prepare and take everything you can and not just a recording device. Take everything in your arsenal because to do otherwise is sheer folly considering the value of your goods.

      From what we are hearing filtering through, we believe there is another Operation Disruption in progress where they are seizing goods for the flimsiest of reasons. Also we have a report of Border Force stopping and searching EVERYONE at Hull P'O Ferries ... despite this tactic being outlawed and illegal since 2002.

      We've booked 2 trips in order to see for ourselves what is going on. lf it's true you can expect fireworks at Hull Terminal :)

      Sounds like they are using the tactic they used with us at the tunnel over the water. Maybe I will need to take my walking stick next time or one of those shooting sticks, so I can sit down while we queue up.
